GENERAL TERMS AND CONDITIONS OF USE AND BOOKING

1. GENERAL INFORMATION
This document sets out the General Terms and Conditions of Use and Booking (hereinafter, the “Terms and Conditions”) of the website www.leonapartamentos.com (hereinafter, the “Website”), owned by Diego Blanco Fierro, with address at Avenida los Cubos 56, 3izq, 24007 León and ID number (DNI) 71448421W, contact email: reservas@leonapartamentos.com.
All apartments advertised on the Website have a “Vivienda de Uso Turístico” licence issued by the Junta of Castilla y León, in compliance with the applicable legal regulations in force.
2. PURPOSE AND SCOPE OF THE SERVICES
Through the Website, users may:
- Check availability, features and prices of the apartments.
- Make reservations and payments.
- Receive personalised assistance and answers to questions.
Use of the Website implies full acceptance of these Terms. If the user does not agree, they must refrain from using it.
3. GENERAL RULES FOR THE USE OF THE ACCOMMODATIONS
The user undertakes to use the accommodation appropriately, respectfully and in accordance with the following rules:
- Smoking is not permitted in the accommodation.
- Pets and animals are not allowed without the prior express written consent of León Apartamentos.
- Parties or events are not permitted.
- Guests must keep noise to a minimum from 22:00 to 09:00.
- Please ensure the door is locked when leaving the apartment.
- Check-in is from 15:00 and check-out is by 12:00. However, we always try to accommodate our guests and remain flexible, subject to availability.
- Please leave the apartment in reasonably tidy and clean condition. Final cleaning is included, but if additional cleaning is required due to exceptional circumstances, an extra charge will apply.
- If you have reserved a garage parking space with us, please note that its use is intrinsically linked to the occupancy of the apartment and is not considered an independent service. Therefore, the latest time to vacate the garage is directly linked to the apartment check-out time (12:00), regardless of the initial arrival time. Nevertheless, whenever feasible and with the host’s prior express authorization, the parking stay may be extended free of charge at the guest’s request.
- If the accommodation has common areas such as the entrance hall, garage, or access areas, the guest must respect the rules of coexistence and cleanliness. Improper or exclusive use of these areas is not permitted.
- Bringing in or removing furniture or appliances, or carrying out works, modifications, or repairs without the hosts’ express authorization, is prohibited.
- It is strictly forbidden to change the settings or configuration of any appliance, electronic device, or home automation system (such as routers, TVs, video intercoms, etc.) without the prior express authorization of the management or the owner.
- Under no circumstances may the maximum occupancy stated in the booking be exceeded.
- Visits from persons not included in the booking must be authorized in advance by León Apartamentos. In no case may the maximum occupancy indicated in the booking be exceeded.
- It is strictly forbidden to assign, rent, sublet, or allow the accommodation to be used by persons not included in the booking without the express written consent of León Apartamentos.
- The accommodation may not be used for purposes other than those for which it was booked.
- The use of the accommodation for commercial, professional, promotional, or audiovisual production activities is not permitted without the express written consent of León Apartamentos.
- Devices that significantly increase the usual consumption of water, electricity, or fuel may not be brought into the accommodation without the hosts’ express authorization.
- Activities that breach the usual rules of coexistence or the normal operating regime of the tourist accommodation are prohibited. The property must be left in the same condition as received.
- Explosive or flammable substances, or any other materials that may cause damage or nuisance to other occupants of the building, may not be brought into the accommodation.
- Guests must not obstruct urgent repair or maintenance works.
- Any activity that disturbs coexistence or prevents other occupants’ normal rest—such as loud music, noise, parties, etc.—in accordance with applicable municipal by-laws, is prohibited.
- The use or consumption of drugs or narcotic substances is prohibited throughout the accommodation.
- Any unlawful use of the internet is prohibited, including the distribution of pornography, fraud, scams, threats, identity theft/impersonation, etc.
- In accordance with Royal Decree 933/2021 (Official State Gazette of 27/10/2021), it is mandatory to collect the information required for the registration of all guests staying at the property. The check-in form must be signed by each guest over 14 years of age; if minors under 14 are travelling, their details must be provided by the accompanying adult.
Admission to and continued stay in the accommodation are subject to compliance with these Terms and the rules of use and peaceful coexistence. León Apartamentos may refuse admission, deny access, or require the guest to vacate the accommodation where there are objective grounds to do so (for example: non-payment, refusal to provide mandatory identification/documentation, exceeding the maximum occupancy, parties or events, repeated noise disturbances, improper use of the accommodation, damage, or unlawful activities). These measures will always be applied on a non-discriminatory basis and in order to safeguard safety, the proper use of the property, and good neighbourly relations.
Failure to comply with the accommodation rules may result in immediate termination of the contract, eviction of the guest without any right to a refund, and may give rise to civil or criminal liability and/or the claim of damages and losses where applicable.
4. BOOKINGS AND CONTRACTING CONDITIONS
To make a booking, the user must complete the booking form, accept these Terms and make the corresponding payment.
León Apartamentos reserves the right to cancel the booking in the event of:
- False, incomplete or contradictory data.
- Non-payment within the established deadlines.
- Suspected fraudulent use or unauthorised use of the accommodation.
Booking confirmation will be sent by email.
5. CANCELLATION POLICY, CHANGES AND RIGHT OF WITHDRAWAL
The customer may cancel the booking free of charge up to 30 days before the arrival date. The customer will have to pay 50% of the total price if they cancel from 30 days before the arrival date until 7 days before. If the customer cancels 7 days before arrival or less, or does not show up, they will have to pay the total price of the booking.
If the customer wishes to make any change to their booking, they must first cancel the current booking and then make a new booking.
In the event of a refund, leonapartamentos.com will charge a €10 administration and management fee and will deduct it from the amount to be refunded.
In the event of early departure by the guest, no partial or total refund of the booking amount will be made.
Right of withdrawal: In accordance with Article 103.l) of Royal Legislative Decree 1/2007, approving the consolidated text of the General Law for the Defence of Consumers and Users, the right of withdrawal does not apply to contracts for the supply of accommodation services for purposes other than housing where the contract provides for a specific date or period of performance.
6. PRICE AND PAYMENT METHODS
All prices are expressed in euros (€) and include the applicable VAT (VAT exempt pursuant to Art. 20.Uno.23º LIVA). Payment by bank card, bank transfer or other enabled methods is permitted.
7. GUEST OBLIGATIONS AND LIABILITY
The guest is responsible for:
- The proper use of the accommodation and its property.
- Reporting any damage during the stay.
- Financially responding for damages or losses caused. The guest will be responsible for any damage caused to the apartment, furniture, appliances or installations during their stay. The costs arising from repair or replacement will be passed on to the booking holder.
7.1. Damages, losses, extraordinary cleaning and related charges
The guest will be responsible for damages, losses or extraordinary dirt caused during the stay. Amounts will be charged when applicable, subject to verification and supporting evidence (for example, immediate communication, photographs and/or invoice/estimate). The following amounts are indicative, and, where applicable, the justified actual cost will be applied up to these limits:
- Loss, misplacement, theft or non-return of keys: for security reasons, it may be necessary to replace the cylinder and/or access lock. The cost will be charged according to invoice or estimate, with an indicative amount up to €300 (double-clutch security cylinder, copies necessary to restore the standard set of keys, and labour).
- Extraordinary cleaning: if the apartment requires cleaning in addition to the standard check-out cleaning (due to exceptional dirt, waste, stains, persistent odours, accumulated rubbish, etc.), a charge up to €60 will apply.
- Smoking indoors: if tobacco consumption is detected inside the accommodation (including persistent odour, cigarette butts or equivalent evidence), the cost of cleaning and deodorising will be charged, with a charge up to €150, without prejudice to other evidenced damages or the possible unavailability of the accommodation due to effectively blocked nights (loss of earnings) if necessary.
- Kitchenware, linen or small items: the equivalent replacement cost (market price of a similar item) plus replacement and logistics costs up to €40 when replacement is necessary.
- Furniture, appliances or equipment: the cost of repair or full replacement according to invoice/estimate, plus coordination and processing costs up to €100 when applicable.
- Unavailability of the accommodation due to damages: if the damages prevent the accommodation from being rented out in whole or in part, the guest will also be responsible for the loss of income due to blocked nights (loss of earnings), calculated according to the effective rate applicable to those dates and the strictly necessary time for the repair, duly evidenced. As an indicative guide, the usual amounts per night may range between €120 (Sunday–Thursday), €160 (Friday), €200 (Saturday) and €400 (holidays and eves), applying in all cases the criterion of proportionality and evidence.
The guest must report any incident upon arrival or during the stay. In the absence of communication, it will be presumed that no apparent incidents have been detected unless proven otherwise.
Once the damages have been verified and evidence provided (photographs and, where applicable, invoice or estimate), the company will inform the booking holder of the amount to be charged. If a damage deposit or a pre-authorisation has been established and accepted, the amount may be applied against that deposit. Otherwise, payment will be requested and, if applicable, claimed through legally provided channels or through the corresponding booking platform.
The company may charge the amount corresponding to repairs or replacements to the payment method provided by the guest or claim them through other means.
8. LIMITATION OF LIABILITY OF LEÓN APARTAMENTOS
León Apartamentos shall not be liable for losses, theft, personal injury or material damage suffered by guests during their stay, unless they derive from negligent action by the accommodation. Use of the facilities, appliances, services and common areas is at the guest’s sole responsibility. Likewise, the accommodation will not be responsible for occasional interruptions in public services (water, electricity, internet, road works, etc.) when due to causes beyond its control or force majeure. Nor will it be liable for inconvenience arising from external works, neighbours’ noise or other situations beyond its control.
9. FORGOTTEN ITEMS
León Apartamentos will keep personal items forgotten by guests in the accommodation for a maximum period of 15 calendar days from the departure date. After that period, if the guest has not requested their recovery, it will be understood that they waive them. In the event a return is requested, the items will be sent by private courier cash on delivery. The estimated shipping cost is about €15 within Spain, not including additional costs for packaging, handling and management, which will also be borne entirely by the guest. León Apartamentos is not responsible for the loss or deterioration of such items during shipping nor guarantees their location once the stay has ended.
Valuable items (jewellery, electronics) will be handed in to the police station only.
10. PERSONAL DATA PROTECTION
The personal data provided by the guest during the booking process will be processed confidentially and in accordance with the General Data Protection Regulation (GDPR). Your personal data will be incorporated into a file under the responsibility of León Apartamentos for booking management and legal compliance. 12. FORCE MAJEURE
León Apartamentos will not be responsible for failure to fulfil its contractual obligations when such failure is due to force majeure or unforeseeable and unavoidable circumstances, including but not limited to: fires, floods, supply cuts, labour disputes, pandemics, government restrictions or any other cause outside the reasonable control of the accommodation.
13. APPLICABLE LAW AND JURISDICTION
These conditions are governed by Spanish law. In the event of a dispute, both parties submit to the courts and tribunals of the city of León, waiving any other jurisdiction that may apply.
14. UPDATING THE TERMS AND CONDITIONS
León Apartamentos reserves the right to modify these Terms and Conditions at any time. The modifications will be published on the Website and will come into force from their publication.
