GENERAL TERMS AND CONDITIONS OF USE AND CONTRACTING

1. GENERAL INFORMATION

This document sets forth the General Terms and Conditions of Use and Contracting (hereinafter, “Terms and Conditions”) of the website www.leonapartamentos.com (hereinafter, “the Website”), owned by León Apartamentos, with tax ID and registered office in León, Castilla y León (Spain). All apartments advertised on the Website have a “Tourist Use Dwelling” license issued by the Junta de Castilla y León, complying with the current legal regulations.


2. PURPOSE AND SCOPE OF THE SERVICES

Through the Website, users may:

  • Check availability, features, and prices of the apartments.
  • Make reservations and payments.
  • Receive personalized assistance and resolution of inquiries.

The use of the Website implies full acceptance of these Terms. If the user does not agree, they must refrain from using it.


3. GENERAL RULES FOR THE USE OF THE ACCOMMODATIONS

The user agrees to use the accommodation properly, respectfully, and in accordance with the following rules:

  • Smoking is not permitted in the property.
  • Pets or animals are not allowed.
  • Parties or events cannot be held.
  • Guests must minimize noise from 22:00 to 09:00.
  • The door must be locked when leaving the apartment.
  • Check-in after 15:00 and Check-out until 12:00, but we always try to adapt to our guests and be flexible depending on availability.
  • The apartment must be left in a reasonable condition of order and cleanliness. Final cleaning service is included, but if extra cleaning is required due to exceptional conditions, an additional charge will apply.

If a garage space has been reserved with us, it is important to highlight that its use is intrinsically linked to the occupancy of the apartment and is not considered as an independent or separate service. Therefore, the deadline for vacating the garage is directly related to the apartment check-out time (12:00), regardless of the initial arrival time. However, and whenever feasible, the parking stay may be extended free of charge if the guest so wishes and with prior express authorization from the host.

If the accommodation has common areas such as entrances, garage, or access areas, the guest must respect the rules of coexistence and cleanliness. Improper or exclusive use of these areas is not permitted.

Introducing or removing furniture or appliances, carrying out works, modifications, or repairs without the express authorization of the hosts is prohibited.

It is strictly forbidden to modify the configuration of any appliance, electronic device, or home automation system, such as routers, televisions, intercoms, among others, without the prior and express authorization of the management or the owner.

The maximum capacity set for the tourist-use dwelling during the booking process cannot be exceeded.

Visitors not registered in the reservation must be previously authorized by León Apartamentos. Under no circumstances may the maximum capacity of the accommodation indicated in the reservation be exceeded.

It is strictly prohibited to transfer, rent, sublet, or allow the use of the accommodation to persons not included in the reservation, without the express written consent of León Apartamentos.

The accommodation may not be used for activities or purposes other than those for which it was reserved.

It is not permitted to use the accommodation for commercial, professional, promotional, or audiovisual production activities without the prior express consent of León Apartamentos.

Devices that increase the usual consumption of water, electricity, or fuel may not be introduced without the express authorization of the tourist accommodation hosts.

It is forbidden to engage in activities that violate the usual rules of coexistence or the normal functioning of the tourist dwelling, and the property must be left in the same condition as it was received.

Explosive, flammable, or other substances that may cause damage or inconvenience to other occupants of the building may not be introduced.

Animals may not be introduced without the express consent of the hosts.

Guests must not obstruct urgent repair or maintenance work.

Any activity that alters coexistence or prevents the normal rest of other users of the building, in accordance with applicable municipal regulations (e.g., loud music, noise, parties), is prohibited.

Smoking or using drugs or narcotic substances is strictly prohibited throughout the property.

Illegal use of the internet is prohibited, such as the distribution of pornography, fraud, scams, threats, identity theft, etc.

In accordance with Royal Decree 933/2021, published on October 26, 2021, all guests over 14 years of age are required to provide their personal data for traveler registration, in accordance with Spanish law.

Failure to comply with these rules will entitle the hosts to require the immediate abandonment of the property.

Non-compliance with these rules may result in the immediate termination of the contract, with eviction of the guest and no right to a refund, and may give rise to civil or criminal liability.


4. RESERVATIONS AND CONTRACTING CONDITIONS

To make a reservation, the user must complete the reservation form, accept these Terms, and make the corresponding payment.

León Apartamentos reserves the right to cancel the reservation in case of:

  • False, incomplete, or contradictory data.
  • Non-payment within the established deadlines.
  • Suspicion of fraudulent or unauthorized use of the accommodation.

The booking confirmation will be sent by email.


5. CANCELLATION AND CHANGES POLICY

The client may cancel the reservation free of charge up to 30 days before the arrival date. The client will have to pay 50% of the total price if canceled between 30 and 7 days before arrival. If the client cancels 7 days before arrival or less, or does not show up, they will have to pay the full price of the reservation.

If the client wishes to make any change to their reservation, they must first cancel the current reservation and then make a new one.

In case of refund, leonapartamentos.com will charge an administration and management fee of €10, which will be deducted from the refund amount.

In case of early departure by the guest, no partial or total refund of the reservation amount will be made.


6. PRICE AND PAYMENT METHODS

All prices are expressed in euros (€) and include current VAT (0%). Payments are accepted by bank card, transfer, or other enabled methods.


7. GUEST OBLIGATIONS AND LIABILITY

The guest is responsible for:

  • The correct use of the accommodation and its goods.
  • Reporting any damage during the stay.
  • Being financially responsible for damages or losses caused.

The guest will be responsible for any damage caused to the apartment, furniture, appliances, or facilities during their stay. Costs arising from repair or replacement will be charged to the reservation holder.

The company may charge the corresponding amount for repairs or replacements to the payment method provided by the guest.


8. LIMITATION OF LIABILITY OF LEÓN APARTAMENTOS

León Apartamentos is not responsible for losses, theft, personal or material damage suffered by guests during their stay, unless due to negligent action by the accommodation. The use of facilities, appliances, services, and common areas is under the sole responsibility of the guest.

The accommodation will not be responsible for occasional interruptions in public services (water, electricity, internet, public works, etc.) when due to causes beyond its control or force majeure. It will not be responsible for inconveniences arising from external works, neighbor noise, or other situations beyond its control.


9. LOST PROPERTY

León Apartamentos will keep personal belongings left by guests in the accommodation for a maximum of 15 calendar days from the departure date. After this period, without the guest requesting their recovery, it will be understood that they renounce them.

If a return is requested, items will be sent via private courier cash on delivery. The estimated cost of shipping is about €15, excluding additional packaging, handling, and management expenses, which will also be fully borne by the guest. León Apartamentos is not responsible for the loss or deterioration of such items during shipping, nor does it guarantee their location once the stay is over.

Valuable items (jewelry, electronics) will only be handed over at the police station.


10. PERSONAL DATA PROTECTION

Personal data provided by the guest during the reservation process will be treated confidentially and in accordance with the General Data Protection Regulation (GDPR).

Their personal data will be incorporated into a file under the responsibility of León Apartamentos for reservation management and legal compliance. You may exercise your rights by sending an email to reservas@leonapartamentos.com.

11. CUSTOMER SERVICE AND COMPLAINTS

12. FORCE MAJEURE

León Apartamentos will not be responsible for the non-compliance of its contractual obligations when such non-compliance is due to force majeure or unforeseeable and unavoidable circumstances, including but not limited to: fires, floods, supply cuts, labor disputes, pandemics, government restrictions, or any other cause beyond the reasonable control of the accommodation.


13. APPLICABLE LAW AND JURISDICTION

These conditions are governed by Spanish law. In the event of conflict, both parties will submit to the courts and tribunals of the city of León, waiving any other jurisdiction that may correspond.


14. UPDATE OF TERMS AND CONDITIONS

León Apartamentos reserves the right to modify these Terms and Conditions at any time. Modifications will be published on the Website and will take effect from the date of publication.
